PRIVACY STATEMENT ON THE PROCESSING AND PROTECTION OF PERSONAL DATA


1.PRIVACY POLICY


We comply with the legal provisions regarding the protection of personal data and implement technical and organizational measures to protect all operations directly or indirectly concerning personal data, which prevent unauthorized or unlawful processing, accidental or unlawful loss or destruction.

For the purpose of processing messages, requests and their honoring SC GIP SRL collects personal customer data, namely name, email address and telephone number, in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the European Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

We process your name, e-mail address and telephone number, for communication with you in order to fulfill contractual obligations and to respond to requests/messages sent through the website.

All these data will be kept for the duration of the young financial-accounting and tax records required by the legislation in question, but not more than 5 years.

We do not use personal data for automated processing or profiling. We never make automated decisions about you. We use technical means to store data securely. We do not process data for secondary purposes incompatible with the purposes for which we collected it.

We strictly respect and ensure the confidentiality of processed data. We only disclose data for the fulfillment of your interests or legal obligations. Confidentiality is an essential value for us.

We may also provide your personal data to other companies with which we are in partnership relations, but only on the basis of a confidentiality undertaking on their part, whereby they guarantee that these data are kept secure and that the provision of this personal information is made in accordance with the legislation in force, as follows: courier service providers, marketing service providers, payment/banking, telemarketing or other services, provided by companies with which we can develop joint programs for offering our Goods and Services on the market, insurers, etc..

In order to place an order, the customer will provide the data and information requested in the online form to send the message, to place the order or by phone, the refusal to communicate the requested information preventing the seller to register and honor the order.

The owner as well as the operator of this website are not responsible for customer errors in entering these data or any false data provided by them. The customer has the obligation to provide correct and factually correct data, bearing full responsibility for the incorrectness of the information provided to the seller.

Personal data will not be sold, transferred or distributed in any form to third parties or in other countries, unless requested by the competent public authorities, in accordance with the provisions of Regulation (EU) 2016/679.

We recommend all users of this website to take all safety precautions when providing personal data online and to periodically check the status and accuracy of such data. Users are directly responsible for how they protect their login data as they may bear the consequences of unauthorized use.

Your rights

According to Regulation (EU) 2016/679, you have the right to access and intervene on the personal data provided.   • Categories of personal data concerned;
  • Recipients or categories of recipients to whom personal data have been or will be disclosed;
  • Where possible, the period for which the personal data are expected to be stored or, if this is not possible, the criteria used to determine this period.

Upon request, we will provide you with a copy of the personal data we process. For any other copies requested, we will charge you a reasonable fee based on administrative costs. If you submit your request to us in electronic format and unless you request a physical format, the information will be provided in a commonly used electronic format (word, pdf, etc.).

Customers also have the right to rectification, modification and updating of processed data. Thus, you have the right to obtain from us, without undue delay, the rectification of inaccurate personal data concerning you. taking into account the purposes for which the data have been processed, you have the right to obtain the completion of personal data that are incomplete, including by providing an additional statement.

You have the right to obtain from us the erasure of personal data concerning you without undue delay, and we have the obligation to erase personal data without undue delay if one of the following grounds exists:

  • Personal data are no longer necessary for the purposes for which they were collected or processed;
  • You will withdraw your consent on the basis of which the processing takes place and there is no other legal basis for the processing;
  • You will object to the processing and there are no legitimate prevailing reasons for the processing;
  • Personal data was processed unlawfully;
  • Personal data must be deleted in order to comply with a legal obligation incumbent on us under European Union law or Romanian law;

In the event that we communicate your data to courier companies or other partners, and you request their deletion, we will take all reasonable steps to inform the data processing partners that you have requested the deletion of any links to the data or any copies or reproductions of such personal data.

Data will not be deleted if:

  • The processing is necessary for compliance with a legal obligation stipulating processing under Union or Romanian law or for the performance of a task carried out in the public interest;
  • For reasons of public interest in the field of public health;
  • The processing is necessary for establishing, exercising or defending a right in court.
  • You have the right to obtain restriction of processing where one of the following applies:
  • Challenge the accuracy of the data, for a period allowing us to verify the accuracy of the processed data;
  • The processing is unlawful, and you will object to the deletion of your personal data by requesting instead the restriction of its use;
  • We no longer need your personal data for processing purposes, but you will ask us for them in order to establish, exercise or defend a right in court.

If data processing has been restricted in the above-mentioned cases, such personal data may, except for storage, be processed only with your consent or for the establishment, exercise or defense of a right in court or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or the Romanian State.

If you have obtained a restriction on the processing of your personal data, you will be informed by us before the processing restriction is lifted.

You have the right to receive the personal data concerning you that you have provided to us in a structured, commonly used and machine-readable format. You have the right to transmit this data to another controller, without hindrance from us, directly from us to another controller, where technically feasible. The exercise of this right is without prejudice to your right to erasure of the data.

Any customer also has the right to object, free of charge and without any justification, to the processing of his/her personal data for direct marketing purposes.

In order to exercise all the above-mentioned rights, you may at any time address a written request to our office in Cârcea, 134 Calea Bucuresti str. . You also have the right to go to court.

Your data will not be transferred to another country.

By filling in the data in the message submission forms, you, the user/purchaser, expressly declare and accept that your personal data will be included in the www.gip.ro database and you give your express and unequivocal consent that all such personal data will be stored, used and processed for the purpose of executing the orders placed or responding to messages and requests sent.

The buyer’s personal information may also be provided to the Public Prosecutor’s Office, Police, courts of law and other authorized state bodies, based on and within the limits of the legal provisions and following specific requests.

You have the right to access, intervene, rectify and modify the data you provide us with, to limit the processing carried out by us and even to request deletion of the data. We note that intervention on the data you have provided to us may be of such a nature as to prevent the performance of the contract concluded between you and us. In this case, we shall be exempt from liability. If you are dissatisfied, you have the possibility to address and lodge a complaint against us before the National Supervisory Authority for the Processing of Personal Data, as well as before the competent courts.
